Bogotá, officially Bogotá, Distrito Capital, abbreviated Bogotá, D.C., and formerly known as Santa Fe de Bogotá during the Spanish Imperial period and between 1991 and 2000, is the capital and largest city of Colombia. The city is administered as the Capital District, as well as the capital of, though not politically part of, the surrounding department of Cundinamarca. Bogotá is a territorial entity of the first order, with the same administrative status as the departments of Colombia. It is the main political, economic, administrative, industrial, cultural, aeronautical, technological, scientific, medical, educational and aiport center of the country and northern South America.

La extradición: herramienta eficaz contra el crimen organizado
presidente Abelardo de la Espriella ordenó la entrega a Estados Unidos de alias Mocho Olmedo, Muñeca, Araña, Pinocho y HH, respecto de quienes la Corte Suprema de Justicia, durante el anterior gobierno, había emitido concepto favorable sobre la procedencia de su extradición, pero tales permanecían suspendidos debido a su inclusión en diferentes procesos de la denominada paz total. Tres se encuentran bajo custodia y dos continúan prófugos. Para comprender la importancia de esta decisión es necesario recordar una de las páginas más aciagas de nuestra historia. Durante los años ochenta y comienzos de los noventa, Pablo Escobar y los narcotraficantes que se autodenominaron Los Extraditables desataron una campaña de terrorismo contra el Estado y la sociedad colombiana bajo una consigna inequívoca: “Preferimos una tumba en Colombia a una cárcel en Estados Unidos”. Magnicidios, asesinatos de jueces y funcionarios, secuestros, bombas y atentados indiscriminados tuvieron entre sus principales propósitos obligar al Estado a renunciar a la extradición. Entre las víctimas de aquella ofensiva estuvieron el ministro de Justicia Rodrigo Lara Bonilla, el magistrado Hernando Baquero Borda, el procurador Carlos Mauro Hoyos, el candidato presidencial Luis Carlos Galán y el exministro Enrique Low Murtra. A ello se sumaron la bomba contra el edificio del DAS, la destrucción del vuelo 203 de Avianca y numerosos atentados que dejaron centenares de muertos. No puede dejarse de lado que el día 6 de noviembre de 1985 los magistrados de la Sala Constitucional de la Corte Suprema de Justicia estudiaban la exequibilidad del tratado de extradición con Estados Unidos cuando ingresó el Comando del M-19, por lo que diversas investigaciones han señalado la participación del grupo denominado “Los Extraditables” en tan luctuoso “holocausto”. En medio de ese clima de violencia e intimidación, la Asamblea Nacional Constituyente aprobó el 19 de junio de 1991 la prohibición de extraditar colombianos por nacimiento, posteriormente incorporada al artículo 35 de la nueva Constitución. El estado sin duda alguno fue sometido por el narcotráfico. La reclusión de Pablo Escobar demostró rápidamente las consecuencias de aquella claudicación. La Catedral no funcionó como una verdadera prisión, sino como un centro de operaciones construido y controlado por el propio capo. Desde allí continuó dirigiendo actividades criminales y ordenando asesinatos. Cuando el Gobierno intentó trasladarlo, escapó en julio de 1992. Aunque Escobar murió en diciembre de 1993, el narcotráfico no desapareció. El Cartel de Cali amplió su poder económico, penetró las instituciones y terminó involucrado en la financiación de la campaña presidencial de 1994, origen del llamado Proceso 8.000. Mediante el Acto Legislativo 01 del 16 de diciembre de 1997, el Congreso reformó el artículo 35 de la Constitución y restableció la posibilidad de extraditar colombianos por nacimiento por delitos cometidos en el exterior, siempre que esas conductas también estuvieran tipificadas en Colombia. Este antecedente demuestra que la extradición no es una herramienta secundaria. Su prohibición representó una victoria estratégica del narcotráfico sobre el Estado, mientras que su restablecimiento significó la recuperación de una capacidad indispensable para enfrentar organizaciones criminales que operan más allá de las fronteras nacionales. La extradición reduce las posibilidades de que los grandes cabecillas corrompan funcionarios, intimiden jueces y testigos, ordenen asesinatos desde las cárceles o aprovechen las debilidades del sistema penitenciario. También permite que sean procesados en jurisdicciones con mayores recursos para rastrear capitales, confiscar bienes, reconstruir redes internacionales e identificar socios, rutas y estructuras de lavado de activos. Su aplicación fortalece, además, la cooperación judicial con otros países y transmite un mensaje inequívoco: participar en una negociación no puede convertirse en un seguro contra la justicia. Durante la administración de Gustavo Petro se hicieron efectivas 913 extradiciones hacia 31 países, la cifra más alta registrada por un gobierno colombiano. Por ello, no puede afirmarse que esa administración haya sido laxa frente a la extradición en términos generales. El gobierno De La Espriella ya ha firmado 41 extradiciones. La controversia se concentra en determinadas decisiones mediante las cuales se suspendió la entrega de cabecillas de alta peligrosidad, pese a que el trámite había avanzado legalmente y, ya contaban con concepto favorable de la Corte Suprema de Justicia. Fueron excepciones cuantitativamente reducidas frente al total de extradiciones, pero cualitativamente graves por el poder de sus beneficiarios y por la posibilidad de que la política de paz total hubiera sido utilizada para proporcionarles una protección injustificada. La necesidad de investigar estas actuaciones adquiere mayor importancia a partir de las declaraciones de la exministra de Justicia Ángela María Buitrago. Según relató, durante su gestión Otty Patiño le solicitó que no se concediera la extradición de alias HH, integrante de Comuneros del Sur, pese a que la Corte Suprema de Justicia ya había emitido concepto favorable. Buitrago calificó esa petición como una “intromisión indebida”, al considerar que intervenir en esa decisión no correspondía a las funciones del alto comisionado para la Paz. Su declaración impide reducir el asunto a una simple discrepancia política alrededor de la paz total. Corresponde establecer si existieron presiones institucionales para frenar o retrasar extradiciones legalmente tramitadas; quiénes impartieron esas instrucciones; cuáles fueron sus fundamentos jurídicos; qué compromisos habían cumplido realmente los beneficiarios y si se invadieron las competencias del Ministerio de Justicia, la Corte Suprema o las autoridades judiciales. La posición de Buitrago demuestra, además, que dentro del propio Gobierno existieron funcionarios que advirtieron sobre estos riesgos. La exministra sostuvo que la Fiscalía no estaba obligada a suspender automáticamente todas las órdenes de captura solicitadas por los negociadores y que debía verificar, caso por caso, el cumplimiento de las condiciones establecidas por la ley y la Corte Constitucional. Su testimonio debe ser conocido formalmente por las autoridades competentes. La gestión de Otty Patiño y las actuaciones de los demás exfuncionarios que promovieron, tramitaron o defendieron estas suspensiones deben ser investigadas. Esto no significa anticipar responsabilidades, pero sí determinar si hubo extralimitación de funciones, presiones indebidas, obstrucción de procedimientos o favorecimiento de determinados cabecillas bajo la cobertura de una política de paz. La extradición tampoco debe servir para privar a las víctimas colombianas de verdad, justicia y reparación. Antes de entregar a un requerido deben preservarse las pruebas y garantizarse mecanismos que permitan esclarecer los homicidios, secuestros, desplazamientos, reclutamientos y demás delitos cometidos en Colombia. La cooperación internacional debe complementar la acción de la justicia nacional, no reemplazarla ni sacrificar los derechos de las víctimas. La historia ya nos enseñó el costo de ceder frente a los narcotraficantes. Pablo Escobar recurrió al terrorismo para arrebatarle al Estado la herramienta que más temía. Colombia tardó seis años en corregir aquella decisión. La decisión del nuevo Gobierno recupera plenamente el poder disuasorio de la extradición y restablece un principio esencial: puede haber oportunidades jurídicas para quienes abandonen realmente la violencia, pero no refugios políticos ni beneficios indefinidos para quienes continúen traficando, asesinando y sometiendo territorios.

Luto en las Fuerzas Militares: Asesinan a soldado en ataque de disidencias en Tuluá, Valle
.- Una nueva tragedia enluta a las Fuerzas Militares de Colombia y evidencia la compleja situación de orden público que sigue azotando a las zonas rurales del departamento del Valle del Cauca. En las últimas horas, se confirmó el asesinato en actos del servicio del soldado profesional Jorge Arbey Díaz Arias, orgánico del Ejército Nacional. De acuerdo con la información entregada por el Comando General de las Fuerzas Militares, el fatal ataque fue perpetrado por miembros de la disidencia armada conocida como el Frente 57 ‘Yaír Bermúdez’, un Grupo Armado Organizado residual (GAO-r) que delinque en esta región y busca mantener el control de los corredores estratégicos. Asesinado mientras protegía a la población civil El hecho de sangre se registró en inmediaciones del corregimiento de Santa Lucía, en la zona montañosa del municipio de Tuluá. Según el reporte oficial, el uniformado se encontraba desplegado en este sector cumpliendo con su misión constitucional de brindar seguridad y proteger a la comunidad ante las constantes amenazas y hostigamientos de las estructuras ilegales. A través de sus canales oficiales, las Fuerzas Militares rindieron un sentido homenaje al uniformado caído bajo la consigna de #HonorYGloriaPorSiempre, enviando un mensaje de solidaridad a sus seres queridos. «Los soldados de tierra, mar, aire y río de las Fuerzas Militares lamentamos profundamente este hecho criminal que enluta a la institución y al país. Elevamos nuestras plegarias al Todopoderoso por su descanso eterno. Expresamos nuestra más sincera solidaridad y acompañamiento a su familia, amigos y compañeros en este difícil momento», señaló la institución en un comunicado. El comando militar ratificó que el sacrificio del soldado Díaz Arias por la seguridad de la patria no será olvidado y aseguró que las tropas mantendrán la ofensiva operacional en la zona de Tuluá y el centro del Valle para dar con el paradero de los responsables de este crimen que enluta al país.
